2018 Anuário Brasileiro do Cobre Brazilian Copper Yearbook 32 Simplify to streamline T he development of the commercial affairs in the contemporary world has demanded the implementation of harmonized politics for the customs regulation by the various countries. As globalization advances and consolidates throughout the 21st century, a strategy for breaking down operational barriers which is hindering the free development of international trade is becoming increasingly necessary, in order to reduce bureaucracy of customs procedures and to conciliate the different technical regulation throughout the world. With this premise in mind, WTO members gathered in Bali in December 2013 adopted the Trade Facilitation Agreement, which is called as the AFC: the largest multilateral trade agreement signed since the Uruguay Round, in 1994. Divided into two sections, the AFC basically establishes a set of principles and rules which aims the reviewing of customs procedures adopted around the world, includingmeasures tomodernize the customs administration, in order to simplify and streamline of foreign trade procedures, as well as providing cooperation between Members in preventing and combating customs infractions. Therefore, the Agreement governs from the time of customs clearance and tax procedures adopted by customs to the measures to promote impartiality and transparency by the customs authorities in general. With the entry into force scheduled for February 2017, the AFC was well received by Brazilian Government, thanks to the continuous efforts of the various jurisdictions that rules international trade under the prism of domestic legislation. An example are the new dossiers implemented by the Single Import and Export Declarations (Duimp and Due, respectively), which, in the so-called single window, promise to focus on just one web screen all the necessary procedures to carry out the operation before the various consenting bodies. But beyond the particular universe of each operator, the AFC has also been incorporated by Brazil as an effective mechanism for the establishment of trade policies. This is the conclusion taken by analyzing the creation of the National Committee forTradeFacilitation -CONFAC, by Decree No. 8.807/2016, an interministerial agency of the Foreign Trade Chamber - CAMEX, that purposes to guide, coordinate, harmonize and supervise the operational activities of agencies and entities of the Federal Government regarding imports and exports and the reduction of costs on compliance with tax requirements. On the other hand, it is a fact that most of the obstacles related to international trade lies precisely in the day-to-day operations, concerning, for example, customs procedures that are adopted differently depending on the place of customs clearance, the lack of unequivocal and uniform criteria for the conduct of the fiscal routine, or even the discrepancy between the conditions of port and airport infrastructure.
